Once you have completed the steps outlined below, you agree to the terms and conditions specified herein, which apply to all photoshoots and events conducted by Finding Light Photography.

1. Our Agreement

This agreement contains the entire understanding between you and Finding Light Photography. It replaces any prior agreements we've had. Any changes need to be written down and signed by both parties. If any part of this agreement isn't valid, the rest still applies. If we decide not to enforce a part of this agreement, it doesn't mean we waive the rest of it.

 

2. Bookings/Reservations

To book your photoshoot/event, Finding Light Photography requires a signed contract and a non-refundable booking fee within 48 hours of receiving this. If you reschedule, postpone, or cancel the photoshoot/event, or breach the contract, the booking fee is non-refundable. You’ll also need to cover any costs incurred by Finding Light Photography up to the time of cancellation.

 

3. Event Schedule

Please confirm the schedule at least one week before the photoshoot/event. Notify us of any changes in schedule or location as soon as possible and ensure we confirm receipt of these changes. Additionally, your client questionnaire must be completed at least one week before the photoshoot/event. Failure to do so will mean that Finding Light Photography is not responsible for issues arising from lack of information.

 

4. Safety

Finding Light Photography reserves the right to terminate coverage and leave the photoshoot/event if we encounter inappropriate, threatening, hostile, or offensive behavior, or if our safety is at risk. You will be notified once, and if the behavior persists, we will leave. All payments made will be retained, and you agree to hold us harmless for any incomplete coverage. 

 

5. Packages

You agree to the packages detailed on our website, including timing and the number of images. We are not responsible for any misunderstandings regarding package details. Should we be mislead by you and given the impression an event is other that what was discussed you will be charged accordingly. Event packages may not be used for family shoots, event package offer a 10-15 minute "smile &shoot" family session only. Should you book an event package with the expectations of a family shoot, you will be charged accordingly. 

 

6. Timing and Additions

Punctuality is crucial. The shooting will start and end at the scheduled times. If you are late, the shoot will still adhere to the scheduled times. Any additional time beyond the scheduled end will be billed to you. If you are more than 15 minutes late, we reserve the right to cancel the session, with a R1500 rescheduling fee applicable if you wish to reschedule. Rescheduling is only permitted no later than 48 hours before the session; otherwise, a R1000 fee applies.

 

7. Expenses

You are responsible for all travel, accommodation, meal, and transport costs unless provided by you. Travel expenses are charged at R7 per kilometer, and this will be applied according to the selected package. 

 

8. Responsibilities

Finding Light Photography is not liable for issues beyond our control, such as obtrusive guests, adverse weather, theft of equipment, schedule complications, incorrect addresses, or location restrictions. We will endeavor to edit photographs for the best results. We do not guarantee coverage of specific groups, individuals or any specific image. You are responsible for ensuring that images are safely kept once delivered.

9. Weather & Lighting

Photography is dependent on weather and available light. Sessions will continue in overcast conditions or light rain. These conditions are not considered grounds for cancellation, refund, or rescheduling. In the case of heavy rain, storms, or unsafe weather conditions, Finding Light Photography reserves the right to reschedule the session to the next available suitable date. No refunds will be issued due to weather.

The final decision to proceed or reschedule rests solely with Finding Light Photography. Finding Light Photography is not responsible for poor lighting due to late arrival, weather changes, load shedding, venue restrictions, or environmental limitations.

 

10. Venue and Location Limitations

We are subject to the rules and guidelines of the location where the photoshoot/event takes place. It is your responsibility to negotiate any modifications to these guidelines with the officials. We will offer technical recommendations as needed. 

 

12. Permits

Finding Light Photography will obtain necessary permissions from locations within our network. For other locations, you must ensure that permission is obtained before the photoshoot/event. Finding Light Photography does not cover the cost of any venues and you will be invoice accordingly. 

 

12. Copyrights

Photos produced by Finding Light Photography are protected by copyright law. You cannot reproduce them without our written permission. If you have purchased an "Online Gallery," you will receive limited copyright ownership upon final payment. You may share these images online as long as they remain unaltered and credit is given to us. Written permission is required for publishing or selling the photos. 

 

13. Model Release

You grant Finding Light Photography the right to use and publish photos of you for editorial, trade, advertising, educational purposes, and other uses. We respect your privacy, and you may request that your images not be shared. 

 

14. Limit of Liability

In the event that Finding Light Photography is unable to perform due to unforeseen circumstances beyond our control (such as injury, illness, or natural disasters), we will make every effort to find a suitable replacement. If you do not accept the replacement and cancel, our liability is limited to returning payments received, excluding the non-refundable booking fee. If digital files are lost or destroyed beyond our control, our liability is limited to returning payments received only and we are not responsible for any other cost incurred by you, including but not limited to outfit hire, cakes, props etc. For partial loss, liability is prorated based on the number of originals lost. We are not liable for the loss of images beyond final delivery and will endeavour to maintain backups but cannot guarantee their safe keeping. It is your responsibility to ensure your images are safely kept. 

 

15. Credit

Any credit you have is valid for 1 year from the invoice date. Credit cannot be used for Mini sessions and is only valid for full sessions. 

 

16. Post Production and Editing

The final editing and selection of images are at our discretion. Retouching of skin is limited to simple spots; additional editing is R950. Photos will be ready in 4-6 weeks. RAW/unedited images will not be released. Research our style beforehand; re-edits cost R1250. Finding Light Photography is not obligated to deliver every image taken. We will decide which images to edit and deliver. 

 

17. Gallery Terms

Once your gallery is ready, you’ll have 3 weeks to complete your selections or download images before it’s deleted. Reloading images after 3 weeks costs R750 for an additional 3 weeks. Screenshotting watermarked images from your gallery is considered theft and is against copyright law. Once your gallery selection has been completed, images have been downloaded Finding Light Photography will not take responsibility for storing images for any period of time. It is recommended that images are stored on an external drive and on the a cloud storage service. 

 

18. Payment Schedule

A 50% non-refundable booking fee is due upon signing the agreement. The remaining balance is due 3 days before or on the day of the photoshoot/event. If you fail to make the payment as specified, we have the right to terminate the agreement, retain any payments made, and not attend the photoshoot/event. 

 

19. Confidentiality

Both parties agree to keep confidential any sensitive information disclosed during the course of this agreement. This includes, but is not limited to, personal information, business practices, and financial details. 

 

20. Client Cooperation

Client cooperation is essential for the success of the photoshoot/event. You agree to provide all necessary information, adhere to schedules, and follow instructions from Finding Light Photography. Failure to cooperate may result in delays or incomplete coverage, for which Finding Light Photography will not be held responsible. 

 

21. Indemnification

You agree to indemnify and hold harmless Finding Light Photography, its employees, and agents from any claims, damages, liabilities, and expenses arising out of or in connection with the photoshoot/event, including but not limited to any third-party claims. 

 

22. Image Usage and Alterations

You may not alter, edit, or modify the images in any way without the written consent of Finding Light Photography. This includes applying filters, cropping, or any other changes.

 

23. Severability

If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

 

24. Pricing

Prices for services or merchandise not included in this contract are subject to change. Credit vouchers can only be used for merchandise from us and have no cash value

 

25. Props and Décor

Finding Light Photography does not include any props, decor or outfit for the sessions. All props must be supplied by you and Finding Light photography will not take responsibility for any and all props incorporated into the session.

 

26. Newborn Lifestyle Terms

Newborn sessions are lifestyle-focused. The baby will not be posed or tightly wrapped. The session will have a “Day In The Life” feel.

 

27. Mini Sessions

Mini sessions are booked in and around the Edenvale area only.
